Business & Real Estate Litigation

Businesses throughout Georgia look to Stone & Baxter’s litigators for guidance, assistance, and aggressive representation in a wide range of business and real estate disputes. Representative litigation matters range from routine contract disputes to novel matters of first impression; from highly technical real estate matters to complex, “winner take all” contests involving the full gambit of injunctive and extraordinary relief.

Our size is not only ideally-suited for matters requiring immediate action, but it also fosters the sort of flexibility, creativity, efficiency, and resourcefulness that urgent matters require, especially those involving closely-held companies and individuals with limited resources.

Identifying Issues

We litigate issues in the following areas on a routine basis:

  • Business transactions
  • Ownership & governance
  • Employment
  • Construction
  • Contracts
  • Lending & collection
  • Real estate
  • Regulatory
  • Tax
  • Bankruptcy

We also have one of the most active real estate litigation practices south of Atlanta. Our real estate lawyers represent developers, builders, bankers and private investors, and buyers and sellers in disputes involving contracts, zoning, and acquisition and development (including office, retail, mixed-use, condominium conversions, and other commercial and industrial developments). They also represent borrowers and lenders in foreclosure and confirmation litigation, two rather technical and unforgiving areas that are prone to frequent litigation in Georgia courts.

Navigating Forums

We appear in state and federal trial courts, including bankruptcy courts, on a daily basis. However, given today’s emphasis on alternative dispute resolution, we also appear frequently in mediations and arbitrations, from local two-party mediations to multi-party arbitrations involving national adversaries with national counsel. Similarly, the nature of our full service firm requires frequent involvement in state and federal regulatory proceedings, especially those involving public utilities.

And of course, business litigation, with its “winners and losers,” often involves appeals. Whether seeing a matter through or being engaged as special appellate counsel, we’re as comfortable trying cases as we are litigating them on appeal. We stand ready to pursue appeals to the Supreme Court of Georgia and the U.S. Supreme Court.

Counseling Clients

More than substantive and procedural competence, our litigation practice is, first and foremost, about understanding our clients and their businesses, identifying their exposure and objectives, and then advocating aggressively, but efficiently on their behalf. And all the while, we work shoulder to shoulder with them, keep them informed, and counsel them through what can be one of, and often is, the most trying and uncertain events in a business owner’s experience.
